LUTZ - A proposed real estate office at Holly Lane and North Dale Mabry Highway is being delayed for several weeks so a zoning hearing officer can review the petition.
Hillsborough County commissioners on Tuesday remanded the request to Nov. 26.
The postponement sends the petition, which was not supported by two county planning agencies and a zoning officer, back through the planning review process.
In September, hearing officer John Crislip concluded that turning the home into a mortgage office would be out of character for the residential area. Brian Hiatt, co-owner of Genesis Mortgage Services, wants to rezone the southwest corner of Holly Lane and North Dale Mabry Highway to allow the office.
The location violates the North Dale Mabry Overlay District plan, which requires commercial uses to be clustered at three main intersections from Van Dyke Road to the county line.
The proposed office would be outside those activity centers and too far from the closest one at Lutz-Lake Fern Road to qualify for a waiver to the county regulations.
Crislip concluded that approving the rezoning would encourage others to seek similar uses not allowed under the county's comprehensive plan.
County planners said the office is inappropriate in the residential area. The house is oriented toward Holly Lane, which is a dead-end street on the west side of Dale Mabry.
